Oath Keeping

Another blog about oath keeping. Why? Because not a day goes by that I don't find a discrepancy in someone that has made sacred oath and not keep it.

Someone posted today this article which as usual I tried to find something that might show a brother or sister at arms trying to do the right thing. In this case I didn't find it.



So when you watch the video it seems to be an ordinary traffic stop, you could argue that the passenger may have been somewhat unreasonable, I tried to. I get where the officers drew their guns. Here is the problem, the breaking of the window, considering that their were children in the car, was unnecessary, the tazing also unnecessary. You know what, lets just say that it could be argued justifiable. Then the statement came from the Hammond Police Department.

So, I did the research and couldn't find anything in Indiana's Code of Justice, revisions, legislations, bills, nothing stating that Law Enforcement officers can without probable cause search and seize an individual nor arrest without probable cause. As a matter in fact there were detailed laws in favor of Jamal Jones to refuse showing his ID. Now if there are municipal laws that states that law enforcement officers can demand ID of anyone in the vehicle during a traffic stop then you have to ask the important question that I ask every oath keeper to ask, is that law constitutional, is that order lawful. If the answer is no then don't do it. The only reason those law enforcement officers took that route is because they had power to do so and used it without regard of the individual's inherited rights by the supreme law of the land.

For those who are or have been in law enforcement I am sure you know the oath of honor.

"On my honor,
I will never betray my badge,
my integrity, my character,
or the public trust.

I will always have the courage
to hold myself and others
accountable for our actions.

I will always uphold the Constitution,
the community,
and the agency I serve,
so help me God."


So my request to the Hammond Police Department, keep your oath by upholding the Constitution, that means not upholding laws that are unconstitutional.

Generation

I decided to conduct a little experiment today. The idea came to me when I over heard two individuals who so happen to be fellow service members. They were debating why same sex marriage was wrong. Individual A said that it was wrong because it was unconstitutional, that states in the constitution that marriage is between man and a woman. Individual B disagree with Individual A, and for a moment I got excited, because I figured that Individual B would correct him in the difference between the Constitution and religion, boy was I wrong, Individual B's response was "No stupid, that's the Bill of Rights". Ugghhh. So it got me wondering, how many young individuals know anything about the Constitution.

I began to ask the simplest of questions. For example, "what is the second amendment in the bill of rights?" 2 out 6 answered it correctly. Then I asked another simple question "where does the term "plea the fifth" come from?" 0 out of 6. I went into a little bit more difficult question, "please state the preamble of the Constitution?" Nothing, 0 out of 6.

So tell me how is it possible for these young service members to defend our freedoms if they don't even know what those are, what our rights are, who decides what? This is why it is without a doubt that we need to take the bull by its horns and do something. We need veterans, Oath Keepers and senior ranking active duty members to mentor this new generation. They are not doing it in the schools, they are not doing it at home, they sure hell not doing it on the TV, movies or video games. This is the generation that we supposedly have hope in but we are failing by not teaching them anything so how in the hell are they going to know how to defend the Constitution and the rights that are inherited by it.

I call for all citizens, military, law enforcement and civil officers that believe in the oath you have made and find a young service member and mentor them. Through my almost 10 years of service I have mentored a hand full of young members, and that is where my hope is. Because I know that they will take what they have learned from me and teach it to others. I know that when they receive an unlawful order that they will question it, because they know the supreme law of the land, they know which legislation are lawful and unlawful, because they know who to report violations to, they know how to run up a chain of command. But they needed training, they needed mentorship.

You made an oath. That oath is for life. Don't give up.

Our Brothers and Sisters

Today I waited at a McDonalds inside a Walmart while my vehicle was being serviced. I noticed a gentleman that was wearing a ripped up sweater and ripped up pants that he had to hold up so they wouldn't fall off. The sweater was a souvenir sweater for Camp Bonzai in Iraq for 2011. He was obviously homeless and he had a dollar to buy a cup of coffee.

I decided to approach the man and I asked him if he served in Iraq. He told me he did, he was a Seabee in the Navy. I handed him five dollars, I knew that Walmart sales ten dollars jeans, and I offered to buy him one, but he refused, what he would really wanted was a sleeping bag. I unfortunately couldn't afford one at that time. My hope is that I can run into him again and buy him that sleeping bag, what I would really like is to get him off the streets and get him help. He was obviously a drug addict.

There are times I really don't know why I serve. Specially when I see one of my own brothers or sisters living in less than acceptable conditions. Who knows why he was on the streets and doing drugs. Statistically the reason is because veterans are left with no choice but to self medicate with alcohol and illegal drugs, they are left homeless because no one wants to deal with a veteran's mental health problems (http://nchv.org/index.php/news/media/background_and_statistics/#demo) .

Last Tuesday during a congressional hearing on the latest invasion incident in the white house, Representative Chaffetz from Utah called for the secret service to next time shoot on site. Not once I heard him talk about the fact that Omar Gonzalez is a Veteran that desperately needed medical support. Not once did he question why a man has gone for so long without assistance from the Government. He was more concerned about shoot first ask later.

At times I forget why sworn a oath to defend the rights and freedoms inherited by the Constitution. I look at some of the people that serve in our government and I am reminded why, because if you and I aren't then this country would have lost our Constitution a long time ago.

Your Oath



The oath for military enlisted, military officers, law enforcement and elected officials are all some what different but they all call for the exact same thing. "I, (NAME), do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same;" is the same in every oath.


So with that, let us look at our armed forces duties and responsibilities to its oath. In the Uniform Code of Military Justice under Punitive Articles 91 and 92 it states that diciplinary action will be taken if you fail to obey any lawful order(s). So what are unlawful orders?


Rod Powers, a retired Air Force Sargent of 22 years, wrote an article on about.com and told the story of the first officer in the U.S. Armed Forces convicted for obeying an unlawful order. The order was made by President John Adams. He wrote:


"The first recorded case of a United States Military officer using the "I was only following orders" defense dates back to 1799. During the War with France, Congress passed a law making it permissible to seize ships bound to any French Port. However, when President John Adams wrote the order to authorize the U.S. Navy to do so, he wrote that Navy ships were authorized to seize any vessel bound for a French port, or traveling from a French port. Pursuant to the President's instructions, a U.S. Navy captain seized a Danish Ship (the Flying Fish), which was en route from a French Port. The owners of the ship sued the Navy captain in U.S. maritime court for trespass. They won, and the United States Supreme Court upheld the decision. The U.S. Supreme Court held that Navy commanders "act at their own peril" when obeying presidential orders when such orders are illegal."


So as you can see, the Supreme Court set the president for the definition of an unlawful order, and even if made by the Commander-in-Chief, you can still be punished for it. Here is my question? Did President Adams get prosecuted for making an unlawful order. History reveals not. Just remember that, specially during our current troubling times. So an unlawful order is any order that would violate the law. In the case of the Navy Commander he violated UCMJ art. 97 Unlawful Detention, and violating legislation passed by congress to only seize ships bound to any French Port.


Through out U.S. Military history there has been numerous cases of service members following unlawful orders and being punished for it.


It is your sworn duty to refuse and report unlawful orders. Now we have the Whistle Blower Act that protects people from reporting unlawful orders. It is your right.


I will tell you my story. I had a superior that ordered me to have my wife see a psychologist. He literally told me that as a direct order. Now who can tell me what article of the UCMJ that violates? I can give you a few. So what did I do, I reported it to the Navy's Inspector General and exercised my right to be protected under the Whistle Blowers act. Nothing happened to me, I wasn't punished for disobeying a direct order from a superior and I the Inspector General insured that my chain of command could not screw over my career for it. The proper people were reprimanded for it and we move on.


So the moral to this story is that we face the decision to do the right thing. There is a force out there that wants us to do the wrong thing, using us as ponds for global agenda, and it has forced us to do things that are illegal, and one day the world is going to hold us accountable for it, what will you say, "I was just following orders", or will refuse and report it.


In order to support and defend the Constitution of the United States you must first obey it.

IDFO TV EPISODE 1 COMING SOON

Alright guys,
I know I have been promising Episode 1 of IDFO TV, and it is not going to be ready today. The good news is, that I have finally got down the framework for the episode, interviews set up and ready to film and I will have it done soon. I feel bad that I haven't kept my word for today, but I am so happy that I will finally have a plan and its ready to be put it in action.

I think you will really enjoy Episode 1, its going to rattle some cages, its going to bring a lot of debate and that is exactly the reaction I am looking for and I think it will guarantee it.

Inception

So as some of you may know, I really wanted to found an organization by the name of Inception of Defending Freedom Organization (IDFO). I have decided that right now is not the time to work on  project of change of that scale. There will be a time one day. In the mean time, I am happy to still spread knowledge and create a network of like minded heroes.

I still plan on working on IDFO TV, all though it is going to take longer than I thought to come out with the first episode. There has been some support on this project and I don't want to let down those that have put effort into it.

This blog will be another mini-project that can make great changes. I believe that this is where I am needed now, in the blogging community and the youtube community. It seems to be the most influential tools at the time and I am happy to use it.

Thank you for all of my supporters. Lets do our job, our sworn oath and carry out our duties. We must defend the Constitution and for what it stands for.
